The composition of the Board of Health of the Simcoe Muskoka District Health Unit is further defined in S.49 of the HPPA, and the regulation Designation of Municipal Members of Board of Health RRO 1990, Reg. 559, s. 26 as follows:

On March 3, 2005, regulation amendments were filed under the Health Protection and Promotion Act (HPPA) to support the merger of the Muskoka-Parry Sound Health Unit with the Simcoe County District Health Unit and with the North Bay & District Health Unit effective April 1, 2005.

As per the amended regulation, the area of the new Simcoe Muskoka District Health Unit will include Simcoe County and the District of Muskoka. The Board of Health of the Simcoe Muskoka District Health Unit will have nine municipal members as follows:

  1. Four members to be appointed by the Municipal Council of the County of Simcoe.
  2. Two members to be appointed by the Municipal Council of the City of Barrie.
  3. One member to be appointed by the Municipal Council of the City of Orillia.
  4. Two members to be appointed by the Municipal Council of The District Municipality of Muskoka.

In addition provisions are made for The Lieutenant Governor in Council to make appointments (less than the number of municipal members), whose length is up to three years and of the Board of Health to enter into an agreement with the band on a reserve. Under these circumstances, the band has the right to appoint a member to the board.
